1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of NoteSecutive and NoteSecutive Training (together, the "App"), provided by AMZing Media ("AMZing Media," "we," "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. What NoteSecutive Is

NoteSecutive is a professional productivity tool for interpreters. It provides a live consecutive/simultaneous transcription workspace (CONS/SIMUL), a digital notepad (PAD), a sight-translation workspace (SIGHT), and searchable terminology references (REF). NoteSecutive Training is a separate practice environment for interpreter skill-building (drills, flashcards, mock sessions).

The App is a note-taking and reference aid. It is not a certified record of interpretation, not a substitute for professional judgment, and not a court reporting, translation-certification, or transcription-of-record service.

3. Eligibility and Professional Use

NoteSecutive is intended for use by adult professional and trainee interpreters. You are responsible for complying with any professional, ethical, or licensing rules that apply to you (for example, court, medical, or conference interpreting standards) — the App does not verify or guarantee compliance with those rules on your behalf.

You are solely responsible for the accuracy of any interpretation, translation, or notes you produce while using the App, and for how and where you use the App during an assignment (for example, respecting any device-use restrictions set by a court, hospital, or client).

4. License

Subject to these Terms, AMZing Media grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control, for your own professional or training use. You may not copy, reverse-engineer, resell, sublicense, or redistribute the App or its bundled reference/glossary content except as Apple's software licensing terms and these Terms allow.

5. Your Content

"Your Content" means the transcripts, notes, drawings, and sight-translation material you create while using the App. NoteSecutive is designed to keep live-work content (CONS, SIMUL, PAD, SIGHT) ephemeral and on-device — see the Privacy Policy for exactly what is and is not stored. You remain solely responsible for Your Content and for any confidentiality obligations (attorney-client privilege, medical confidentiality, court rules, NDAs, etc.) that apply to the material you interpret.

Training-subsystem progress and practice data may sync to your personal iCloud account via Apple CloudKit so it's available across your own devices; AMZing Media does not host a separate server copy of that data.

6. Screen-Capture Protection (Best Effort)

The App is built to keep CONS, SIMUL, and SIGHT out of the actual image captured by a screenshot or screen recording. PAD, CONS, SIMUL, and SIGHT are all hidden on screen while screen recording or mirroring is active. iOS does not give any third-party app a documented, guaranteed way to control screenshot or recording behavior, so these protections rely on iOS platform behavior that could change in a future update, and they cannot stop someone from photographing the screen with a separate camera or device. These features are a best-effort safeguard, not an absolute guarantee, and should not be your only protection for privileged or confidential material.

7. Purchases and Subscriptions

Some reference packs, glossaries, or features may in the future be offered as paid add-ons or subscriptions through Apple's In-App Purchase system. Pricing, billing, and refunds for any such purchases are handled by Apple under Apple's App Store terms.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT SPEECH RECOGNITION, TRANSLATION AIDS, GLOSSARY CONTENT, OR SCREEN-CAPTURE PROTECTION WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMZING MEDIA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFESSIONAL REPUTATION, ARISING FROM YOUR USE OF THE APP — INCLUDING DAMAGES RELATED TO INTERPRETATION ACCURACY OR DISCLOSURE OF CONFIDENTIAL CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (OR $10 IF YOU PAID NOTHING).

10. Termination

You may stop using the App at any time by deleting it. We may suspend or end your access to the App at any time, with or without notice, including for violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the App will be brought in the state or federal courts located in San Joaquin County, California, and you consent to that venue.

12. Changes to These Terms

We may update these Terms as the App changes. If we make material changes, we'll update the "Last Updated" date above and, where practical, notify you through the App.
